First.- GENERAL CONDITIONS OF CONTRACT
These general contracting conditions, together with the particular conditions that may be established, will expressly regulate the relations arising between HOMEKIT SL with address Av. do Alcalde de Lavadores, 122, Vigo, Pontevedra, with NIF number B32319618 and third parties (hereinafter "Users") who use the Internet portal www.masterled.es (hereinafter the "Portal"), as well as with third parties that contract the products offered through the same HOMEKIT SL reserves, at all times, the right to modify unilaterally, without prior notice, and at any time the presentation and configuration of the Portal.
These General Conditions have been prepared in accordance with the provisions of the Law on the Defense of Consumers and Users, Royal Legislative Decree 1/2007 of November 16, Law 7/1998 on General Conditions of contracting, Law 7/1996 on the Regulation of Retail Trade, Royal Decree-Law 14/1999 regulating the Electronic Signature and any legal provisions that may be applicable.
By using the Portal of HOMEKIT SL, you acquire the status of User. Both the visit and the use and / or acquisition of any of the products of the Portal, imply acceptance as a User, without reservations of any kind, to each and every one of the General Conditions, as well as, where appropriate, to the Particular Conditions that, where appropriate, govern the acquisition.
HOMEKIT SL may, at any time and without prior notice, modify these General Conditions, by publishing said modifications on the Portal so that they can be known by Users always before visiting the Portal or acquiring any goods offered on the Portal.
Second.- PRODUCTS OFFERED AND PURCHASE SYSTEM
A) The products offered on the Portal, together with their characteristics and prices will appear on the screen. Likewise, the shipping costs to the buyer's address of the products will appear on the screen, which will always be borne by the buyer. These products will be available for sale while stocks last.
The prices indicated on the screen are in euros and do not include the l.V.A.
B) The offers will be duly indicated on the screen, HOMEKIT SL reserves the right to decide, at any time, the products that are contained and offered to Users through the Portal. In this way, HOMEKIT SL may at any time add new products to those included in the Portal, it being understood, unless otherwise provided, that such new products will be governed by the provisions of the General Conditions in force at that time.
Likewise, HOMEKIT SL reserves the right to stop offering, at any time and without prior notice, any of the items offered on the Portal.
For the acquisition of the products offered on the Portal, HOMEKIT SL will ask Users to register, for which said Users, who must be over eighteen (18) years old, must complete the instructions that appear on the screen and that they will need to execute. The Username and Password are personal and non-transferable. HOMEKIT SL may make, with adequate notice, modifications in the username and / or password, in which case the modified keys will lose their validity.
Once the User has registered, and to proceed with the purchase of Products, he must add the product he wants in the Shopping Cart, according to the indications contained on the screen, completing for this purpose the order form provided and sending it to HOMEKIT SL, which implies the reading and acceptance of all these General Conditions, as well as, where appropriate, the existing Particular Conditions.
C) Once the purchase has been made and in the shortest possible time, always before thirty (30) days have elapsed since the execution of the purchase, the Customer Service Department of HOMEKIT SL, will send the buyer User to the address indicated in the form the corresponding invoice. The order confirmation sent by HOMEKIT SL, will not be valid as an invoice, only as proof of purchase.
Third- METHOD OF PAYMENT, DELIVERY OF ORDERS
A) The payment of the price of the goods purchased and the shipping costs, which will appear on the screen, is prior to the shipment of the purchased products, reserving HOMEKIT, S.L. to paralyze the shipment in the event of any incident in the payment.
You can make your payments by Credit or Debit Card, PayPal, Bank Transfer to the specified account number, cash on delivery or with seQura (Deferred or financed payment). All our payment systems are totally secure. All data provided for these purposes are encrypted under the SSL (Secure Socket Layers) protocol to ensure maximum security.
HOMEKIT SL undertakes to deliver the goods purchased by the User, at the buyer's address, indicated for this purpose in the order form, in the shortest possible time and, in any case, always within thirty (30) calendar days from the date of formulation of the order. The shipping costs of the purchased objects will be paid by the Buyer.
The shipment of the material will be made in a maximum period of 2 days once the payment of the invoice has been made and confirmed and prior availability of stock. If the material is not available, Masterled will inform the customer of the possible delay time by offering an alternative product. In this case the customer may cancel the order and request a refund of the amount paid.
Shipping costs for purchases less than € 50 * of taxable base will have an extra cost of € 5.15 + VAT (Except shipments outside mainland Spain). However, there may be additional charges in transport when the goods have special measures.
In case of loss, misplacement or damage of the goods caused by the carrier, the customer must notify it within 48 hours of receipt of the order, by phone or email to email@example.com also indicating the incident on the delivery note of the carrier.
In case of receiving an incorrect order, the customer must notify it before 48 hours after receiving it, by phone or email to firstname.lastname@example.org indicating what the incident is.
Once the indicated deadlines have elapsed without any type of claim having been formalized, no returns/incidents will be accepted, except those expressly accepted by the supplier.
MasterLed will not be responsible for delays in the deliveries of the merchandise for reasons beyond its control such as delays in the transport agency, strikes, demonstrations, etc.
- All MasterLed shipments are sent from Spain by Express mode and urgent Private Courier.
- All orders that are processed before 4:30 p.m., will be delivered in 24/48 hours (working days).
- Deliveries are made from Monday to Friday.
- Shipping costs for purchases under € 50 * will have an extra cost of € 5.15 + VAT (peninsula only).
- Free shipping if your purchase exceeds € 50* of tax base. (peninsula only)
- Cash on delivery shipments carry a cost of € 1 + VAT, which will be included in the order.
- In shipments to the Canary Islands, Ceuta and Melilla, the customer must bear the costs derived from the clearance of Customs.
- HOMEKIT, S.L. guarantees 100% the delivery of your order and remember that if you are not satisfied, you can return the product and we will refund your money in full, see our Returns policy.
(*) For shipments within mainland Spain made by private customers
All our products are subject to quality controls and are guaranteed against production defects for a minimum period of 3 years* from the date of purchase. The warranty covers any defect in manufacturing, design or material, although it will be necessary to reveal the lack of conformity within 14 days of receipt of the goods. The warranty covers only defective products. It does not cover shocks, improper use, or others that are not attributable to a defect of the supplier or a defect in the product. During the warranty period, at his option, the CUSTOMER may notify us of a defect in the product and we will proceed to repair or replace it, and if this is not possible, we will refund the amount paid. The transport costs generated by the returns under warranty, exceeded a period of 14 days will be borne by the CLIENT.
* The ordinary warranty period of 3 years begins to apply for any order placed on or after January 1, 2022
All products that are sent from our wvw.masterled.es store are reviewed to check their correct functioning and avoid discomfort to both parties. But being aware that there may be incidents upon receipt of the items purchased, we provide instructions for returning them.
You can return the products purchased within 14 days of receipt of the same, in case they have any damage, both in origin and during transport. To do this, they must follow the following steps:
- Send us an email to HOMEKIT, S.L. informing us that you will return the item and reason.
- Once we receive the return request, we will confirm it by sending you a return number.
- Once the return number is provided, the items must be sent to our facilities or request a collection from our carrier for return.
Once we receive the product, we will contact you to determine if you want us to send you another item of the same characteristics, exchange it for another type of item, or refund the amount.
Upon delivery of the goods by the carrier, the package must be checked, and in case of observing any anomaly, it must be stated on the delivery note (broken package, open package, unsealed etc.). And as a rule even if nothing suspicious is appreciated in the packaging, Sign: Conform pending review.
If the damage is due to misuse attributable to the customer, HOMEKIT, S.L. will not proceed to replace the item, nor refund the amount paid.
Communicate your telephone number in the emails you send us on the occasion of the return, in order to expedite and keep you informed of the procedures followed.
Returned items will need to be received with their original packaging.

Seventh.- RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within 14 calendar days without the need for justification.
The withdrawal period will expire 14 calendar days from the day that you or a third party indicated by you, other than the carrier, acquired material possession of the goods.
To exercise the right of withdrawal, you must notify HOMEKIT SL, calle Av. do Alcalde de Lavadores, 122 - 36214 Vigo, Pontevedra or email email@example.com your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, fax or email). To comply with the withdrawal period, it is sufficient that the communication regarding the exercise by you of this right is sent before the corresponding period expires.
Consequences of withdrawal:
In case of withdrawal on your part, we will refund all payments received from you, except delivery costs. without any undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise; In any case, you will not incur any expenses as a result of the reimbursement.
We may withhold reimbursement until we have received the goods, or until you have provided proof of the return of the goods, whichever comes first.
You must return or deliver the goods directly to us or to HOMEKIT SL, at Av. do Alcalde de Lavadores, 122, Vigo, Pontevedra, without any undue delay and, in any case, no later than within 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. The deadline will be considered fulfilled if you return the goods before the end of the period.
You will only be liable for any decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.
For the purposes of these General Conditions, and for any communication that is necessary between HOMEKIT SL and the User, they must contact the Customer Service by email (sending a message to firstname.lastname@example.org) or by written communication addressed to the Customer Service Department of HOMEKIT SL, Av. do Alcalde de Lavadores, 122, Vigo, Pontevedra. The communications of HOMEKIT SL to the User will be made according to the data provided by the latter when registering on the Portal.
Ninth.- APPLICABLE LEGISLATION
This contract will be governed by Spanish law, which will be applicable in what is not provided in this contract in terms of interpretation, validity and execution. In the event of any discrepancy or claim between the parties in relation to compliance or content of these General Conditions, the parties will negotiate in good faith to try to resolve such discrepancy or claim within a maximum period of one (1) month from the date on which either of them formally notifies the other that the discrepancy has arisen or notifies the claim. In this case, if the discrepancy or claim is not resolved within the maximum period indicated, the parties submit, in the case of legal persons, expressly waiving any other jurisdiction, to the Courts and Tribunals of Ourense, and in the case of natural persons of the competent Courts and Tribunals in each case.
